Terms of use
1. Purpose and acceptance
These terms of use (the "Terms") govern your use of the Hoolu app (the "App"), published by FOCUS TESTING LTD, a private limited company registered in England and Wales under number 15429929, whose registered office is at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("we", "us").
By downloading or using the App, you accept these Terms. If you do not accept them, do not use the App.
If you are under 18, you may use the App only with the agreement of a parent or legal guardian, who accepts these Terms on your behalf.
2. What Hoolu does
Hoolu helps you find your phone. When listening is on, it recognises a double clap or a whistle and makes your phone ring, flash and vibrate. Motion guard sounds an alert when someone moves your phone while it is armed. The App shows no ads. Its features are available with Hoolu Premium (section 7), which starts with a free trial.
3. Limits of the service
- Hoolu recognises claps and whistles with sound-recognition models. It may miss a clap or a whistle (distance, noise, a phone in a bag or a pocket, a covered microphone) and may occasionally react to a similar sound.
- Hoolu can only work while it is allowed to: listening may stop if you deny the microphone or notification permission, if battery saving or the system closes the App, during the quiet hours you set, after your phone restarts, or if your phone is switched off or its battery is empty. Do Not Disturb or other device settings may also silence alerts.
- Motion guard is a deterrent, not a security system. It does not prevent theft, locate your phone or contact anyone, and we do not guarantee that it will go off in every situation.
- When your phone rings, Hoolu plays its sound at the volume you chose, which can be loud. Do not hold your phone close to your ear while testing an alert.
4. Acceptable use
You agree to use the App only on devices you own or are allowed to use, and in compliance with the law that applies to you. You agree not to use it to listen to, monitor or track other people, not to try to bypass its limits or the Hoolu Premium subscription, not to resell, redistribute or tamper with it, and not to disrupt our services.
5. Limitation of liability
The App is provided "as is". We work to keep it running properly but do not guarantee that it will be free of errors or interruptions, that it will detect every clap, whistle or movement, or that it will help you find or protect your phone in every situation. To the extent permitted by law, we are not liable for the loss, theft or damage of your phone or of anything else, nor for any indirect loss.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot be excluded by law, nor the rights you have under mandatory consumer protection law (including the UK Consumer Rights Act 2015 and the law of the country where you live).
6. Your data
What your microphone and motion sensor pick up is analysed on your phone and never recorded or sent. The App has no account and shows no ads. The measurement of our ad campaigns (which you can turn off in Settings › App › Ad campaign measurement) and purchases involve the partners described in the privacy policy, which forms part of these Terms.
7. Hoolu Premium
Hoolu Premium gives full access to the App: listening for claps and whistles, Motion guard, all sounds and settings. It is offered as a yearly subscription that starts with a free trial (7 days when this page was last updated). Without an active subscription or trial, the App only shows the subscription screen; the sound test of the introduction can be tried before subscribing. The price, the length of the free trial and the benefits are shown on the subscription screen, in your currency, before you subscribe.
- Payment: charged to your Google Play or Apple account when you confirm the purchase, or at the end of the free trial. We never have access to your payment details.
- Free trial: the subscription starts and is charged automatically at the end of the trial, unless you cancel at least 24 hours before it ends. A free trial is available once per account.
- Automatic renewal: the subscription renews automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the end of the current period.
- Cancellation: at any time in your store account (Google Play › Payments & subscriptions › Subscriptions, or iPhone Settings › your name › Subscriptions). Premium stays active until the end of the trial or of the period already paid; after that, listening and Motion guard stop and the App shows the subscription screen again. You can also open your subscription from Settings › App › Hoolu Premium. Uninstalling the App does not cancel a subscription.
- Refunds and right of withdrawal: purchases are processed by Google or Apple, and refunds follow their policies. Because Premium is unlocked immediately at your request, you agree that the 14-day right of withdrawal for digital content ends once Premium is activated, to the extent permitted by law. Any right to withdraw from a purchase that the law of your country grants you and that cannot be waived (for example, seven days from the purchase in Brazil) is not affected.
- Restore purchases: use Restore purchase in the App to restore Premium on a new device using the same store account.
8. Intellectual property
The App, its code, name, logo, sounds and design belong to FOCUS TESTING LTD or its licensors. Third-party components are used under their own licences, listed in the App. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control. You may not copy, modify, decompile, reverse-engineer or redistribute it, except where the law allows it.
9. Apple App Store
If you downloaded the App from the App Store, these Terms are between you and FOCUS TESTING LTD, not Apple. Apple is not responsible for the App, its maintenance, support or any related claim. Your use of the App must also comply with the App Store Terms of Service, and Apple and its subsidiaries are third-party beneficiaries of these Terms. Apple's Standard End User Licence Agreement also applies, and these Terms prevail in case of conflict to the extent permitted.
10. Suspension and termination
We may suspend or end your access to the App or to Hoolu Premium if you seriously breach these Terms, in particular section 4, or if the law, a court or a competent authority requires it. Where it is reasonable to do so, we tell you why. If you believe we made a mistake, write to focus.target.app@gmail.com. Sections 5, 8 and 12 continue to apply after your access has ended.
11. Changes
We may change the App and add, modify or remove features. We may also update these Terms; the date at the top of this page shows the latest version, and any material change will be shown in the App. You can stop using the App at any time by uninstalling it.
12. Governing law and disputes
These Terms are governed by the laws of England and Wales. If you are a consumer, you also benefit from the mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country or of England and Wales.
Before any claim, please contact us at focus.target.app@gmail.com so that we can try to find an amicable solution.
These Terms are written in English. If a translation differs from the English version, the English version prevails, except where the mandatory law of your country provides otherwise.
